案例简介:武汉L先生,主要从事房地产生意,资金来源与此。申请人做的是投资2类移民的申请。现行的投资移民新政策是2009年07月29日推出的,需要申请人满足:1)拥有相当于250万新西兰元(人民币1250万)的资产,能够投资新西兰元150万到新西兰。2)有3年或以上的经商经历 3)有英文雅思 3分的水平,获批时,申请人全家一步到位取得居留权(RV)。(带有条件),只要保持投资在新西兰境内4年,主申请人在后3年每年在境内居住146天,条件就会取消,届时,申请人获得无条件的永久居留权(PRV)。这个居留永久有效,也没有任何居住要求(全世界西方福利国家中新西兰**)。

We have accepted the evidence that you provided for the transfer of your nominated investment funds to New Zealand and placement in an acceptable investment(s).
Please forward your three passports along with NZD 930.00 payment for your migrant levy fees (i.e. NZD 310.00 for each person included in the application).
English language tuition fees or further evidence of English language ability are required forand.If there is no evidence of English language ability for your partner or daughter the ESOL Tuition fees to be paid are NZD 6,795.00 each.Please forward these along with the completed contracts previously sent to you.
Section 49(1) conditionsYour residence is subject to conditions imposed under section 49(1) of the Immigration Act 2009.You and your accompanying dependants will need to meet the section 49(1) conditions, otherwise you may become liable for deportation. The conditions imposed on you and your accompanying dependants included in your application are that:
i you retain NZ$1.5million in an acceptable investment(s) in New Zealand for a minimum period of four years from 29 February 2012, the date that you completed the investment of your funds; and ii you, as principal applicant, meet the requirements for minimum time spent in New Zealand over that period, which is 146 days in each of the last three years of your four year investment period; and iii you inform the nearest branch of Immigration New Zealand of any change of New Zealand address during your four year investment period; andiv within three months after the two-year anniversary of your investment period, you submit evidence to INZ that you: are retaining an acceptable investment(s) in New Zealand;andare meeting the requirements for minimum time spent in New Zealand; andv within three months after the expiry date of your four year investment period, you submit evidence to INZ that you have met requirements (i) and (ii) above. If you change your investment(s) during the four year investment period, you will need to ensure that your investment(s) continue to meet these requirements, and that you will be able to provide evidence of the changes.
If section 49(1) conditions are metIf you meet the section 49(1) conditions, those conditions will be cancelled. A business immigration specialist will write to you to confirm the cancellation of section 49(1) conditions on your and your accompanying dependants resident visa(s).
If section 49(1) conditions are not metNon-compliance with section 49(1) conditions may result in you becoming liable for deportation under section 159(1)(a) of the Immigration Act 2009. If a deportation order is issued, you will have to leave New Zealand.

This assessment was completed yesterday and I am pleased to confirm that Mr Luo’s transfer of funds has been approved.
Before investing these funds in New Zealand I would suggest that you forward a proposed portfolio to ensure that investments meet Immigration New Zealand requirements for "acceptable investments".
It is noted that Mr Luo did not transition over to the new instructions that came into effect on 25 July 2011. His "acceptable investments" will therefore be those under the instructions prior to that date.
