申请人从2005年到现在在一家床上用品零售店担任店经理,在这期间曾有2年的时间出国求学。客户想去新西兰经营类似的生意,因为客户有零售行业丰富的经商管理经验;但是客户的父母已经去了新西兰,正在经营礼品/纺织品生意,如何向移民官说明同行业之间的竞争以及市场分配和供应商之间的问题并不容易。在商业顾问详细调研之后,我们给客户选择了一个十分合理且有商业发展潜力的区域,同时也详细说明了客户以后发展的计划。因为准备材料的完整性以及创业项目的高度可行性,只用了一个月的时间就收到了移民官的原则批准。

Your work visa Please send your passport and your spouse’s passport to this office before 29 September 2012, so that we can grant your visas. The visas will allow you to travel to New Zealand and operate your business. We will return your passport(s) within 10 working days. Please let us know if you cannot send us your passport(s) before 29 September 2012. How long will your work visa be valid for?Your visa will be valid for nine months from the date it is granted. At the end of this time, you may be able to apply for a further 27 months (see below for more information).Your spouse will be granted an open work visa that is valid for the same length of time as your work visa. Your work visa and travel conditionsYour work visa will be granted with travel conditions. Your travel conditions will allow you to travel outside New Zealand and be granted re-entry into New Zealand as many times as you like. What happens after the first nine months?Once you have successfully set up your business, you can apply for a visa for a further 27 months, that is, the balance of the three years available under the Long Term Business Category. The immigration instructions provided at the end of this letter provide more details about how to apply for the balance of the three years. You will not need to submit a new application form, but you will need to apply while your work visa is still valid. You will need to send us evidence that you have transferred your funds to New Zealand in line with the requirements set out in immigration instructions (copy attached), and that you have taken reasonable steps to establish and operate your business in New Zealand. Successful principal applicants under this category will be granted a 9 month work visa to allow them to establish and commence the operation of the proposed business in New Zealand. b. A further work visa may be granted for the balance of the 3 year period (i.e. 27 months) if the principal applicant applies within the validity of their current work visa and a business immigration specialist is satisfied that: i. the investment capital for the proposed business, as stated in the business plan, has been transferred direct from the principal applicant’s bank account(s) through the banking system to New Zealand; and ii. reasonable steps have been taken to establish or invest in the business as set out in the business plan. c. In cases where a business immigration specialist is not satisfied that the requirements of BC9(b)(ii) have been met, but that the applicant may be able to meet these requirements within a specified time, a further work visa may be granted for a period of less than 27 months to allow the principal applicant to take further steps to establish and operate the business. To be granted a further work visa at the expiry of that second period, the principal applicant must demonstrate that they meet the requirements in BC9(b)(ii) above. BC9.1 Evidence of reasonable steps taken to establish and operate a businessa. Evidence of transferring investment capital to New Zealand through the banking system may include but is not limited to: i. telegraphic transfer forms ii. other documents, evidence and information the business immigration specialist considers may demonstrate the transfer of investment capital to New Zealand through the banking system. b. Evidence of reasonable steps taken to establish and operate a business may include but is not limited to: iii. documents evidencing the constitution of the business (e.g. certificate of incorporation) iv. audited accounts v. GST records vi. other tax records vii. property purchase or lease documents relating to the business’ site viii. invoices for business equipment and supplies ix. other documents, evidence and information a business immigration specialist considers may demonstrate reasonable steps taken to establish or invest in a business (e.g. employment agreements, bank statements, utility company invoices).
