投资者(投资者2类)规定申请人先要提交一份意向书(EOI)。这是一个计分的系统。在递入的意向书中,得分最高者更有可能被邀请申请居留。如果你被邀请申请居留,你必须在收到邀请信的三个月内递交居留申请。

一个合法的企业是在合法的商业环境下运营,并且是以获利为主要目标,而不是主要为了被动或投机的目的。

·投资资金有哪些要求?

你必须证明你提名的资金和/或资产,这些资金和/或资产是合法赚取或得到的。所有的资金必须要按可被接受的方式进行投资。

·我可以指定馈赠给我的资金吗?

如果你的部分资金和/或资产是通过继承所得,你将需要提供适当的证据,例如,你的律师提供的遗嘱或证据表明资产和/或资金是合法获得的。

·什么是可接受的投资方式?

一个可接受的投资方式是指投资于:

1。符合以下一种或多种方式:

⊕由新西兰政府或地方当局发行的债权

⊕由在新西兰的债券市场(NZDX)交易的新西兰公司发行的债券

⊕由至少为BBB-的新西兰公司,或由国际认可的评级机构评定的等同评级。(例如,标准普尔)

⊕在新西兰公司的股票(包括上市或私人),包括管理基金

2。能够在一般情况下,获得商业回报,并且有潜力为新西兰经济作出贡献

3。以新西兰货币形式投资

·什么是投资基金的个人使用?

·如果我的居留申请原则上获批了,那么我要在多久的时间内把我的资金投资到新西兰?

你应当把你全部的投资资金转移到新西兰,原则上要在12个月的批准期内,把资金按可接受的方式投资。

如果你不能在12个月的批准期内清算你的资产,转移和投资你的资金,你有可能可以要求12个月的延长期。

如果在12个月内(最多为24个月,如果延期获准的话)转移你的资金,那么你的申请将被拒绝。

·一旦我的申请被批准了,我可以先到新西兰调查投资的机会吗?

一旦你的申请在原则上被批准了,你有资格获得12个月多次入境的工作签证来新西兰调查投资机会。

你的配偶和子女在同一时期将有资格获取多次入境的旅客签证。如果你的子女希望在这段时期内学习,他们必须要申请学生签证,并满足学生签证的政策。

如果获得批准的话,可以延长一次12个月多次入境的工作签证。

How many options are available under the MigrantInvestment Policy?

TheMigrant Investment Policy has two residence sub-categories. These are:

·Investor Plus (Investor 1 Category); and

·Investor (Investor 2 Category).

How many places are available under the MigrantInvestment Policy?

Thereis no limit on the number of Investor Plus (Investor 1 Category) applicationsthat can be considered. The Investor (Investor 2 Category) has a cap of 300approved applications per year.Thesesit within the total number of places available under the Skilled/Businessstream of the New Zealand Residence Programme.

Youcan lodge your residence application directly if you apply under the InvestorPlus (Investor 1 Category).

How much is the application fee for the InvestorPlus (Investor 1 Category)?

Theapplication fee for the Investor Plus (Investor 1 Category) is NZ$3400.

Investor (Investor 2 Category) requirements

How do I apply under the Investor (Investor 2Category)?

TheInvestor (Investor 2 Category) is managed by requiring applicants to firstsubmit an Expression of Interest (EOI). This is a points-based system. Thosewith highest total points in their EOI may be invited to apply for residence.If you are invited to apply for residence you must lodge your residenceapplication within three months of the date of our letter of invitation.

How do I submit an EOI?

Youmust fully complete the Investor (Investor 2 Category) EOI form and send it,along with the fee, to the Business Migration Branch. You do not need toprovide any documentary evidence with your EOI.

How often does EOI selection happen?

EOIswill be selected from the Pool every two weeks.

If my EOI does not get selected from the Pool,how long can my EOI remain in the Pool?

AnEOI is current for a period of six months from the date of initial entry to thePool.

How many points will I need to go into theInvestor (Investor 2 Category) EOI Pool?

Toenter into the EOI Pool, you must meet prerequisites for health, character,English language, age, business experience, investment funds and settlementfunds, and have aminimum points scoreof 20 or more. These points accrue from the minimum requirements for:

·English language – IELTS 3 level:1 point

· Age – 65 years:0 points

·Business experience 3 years:9 points

·Investment funds NZ$1.5 million:10 points

How many points do I need to have in order to beselected from the EOI Pool and issued an Invitation to Apply for residence?

Thereis no pass mark for EOIs being selected from the Pool. EOIs will be selectedperiodically from the Pool according to their points ranking in sufficientnumbers to suit the places available under the Investor (Investor 2 Category)at the time of selection.

How can I increase my chances to be selectedfrom the Pool?

Peoplewith highest total points in their EOI will be selected from the Pool. You mayqualify for additional points for English language, age, business experience,and investment funds.

What happens if I reach age 66 while my EOI isstill in the Pool?

Youcannot apply for residence under the Investor (Investor 2 Category) if you areaged 66 or over at the time of your application.In that situation your EOI would be removedfrom the Pool.

Can I change the makeup of my total points scoreafter INZ has invited me to apply?

Example: an EOI was selected at 31 points with the minimum one point for English, ninepoints for business experience, one point for age and 20 points for investmentfunds.In the three-month period betweenbeing invited to apply and submitting his application, the client sat anotherIELTS test and achieved an overall band score of 5.He advised the case officer that he wished tonow claim 10 points for English language and decrease his proposed investmentpoints from 20 to 10 still leaving an overall score of 31 points.

Therelevant section of policy isBJ5.5 Approvalof applications under the Investor 2 Category,which says that for an application under the Investor 2 category to beapproved,“theprincipal applicant must qualify for the points on the basis of which their EOIwas selected from the Pool”.

However,it goes on to allow for consideration of the request to change points after anITA has been issued: “ifa principal applicant does not qualify for the points for business experienceand nominated investment funds on the basis of which their EOI was selectedfrom the Pool (see BJ4.20), a business immigration specialist may, on a case bycase basis, determine that the application may nevertheless be approved, wherethe principal applicant has satisfied a business immigration specialist thatthere was a reasonable basis for making the claim for points in the Expressionof Interest and that in making that claim there was no fraud, or intent toprovide false or misleading information.”

Are there any requirements for businessexperience?

Youneed to have at least three years’ business experience to be approved forresidence under the Investor (Investor 2 Category). Business experience isrecognised if it is experience in planning, organisation, control, seniorchange-management, direction-setting and mentoring acquired through ownershipof, or management level experience in, a lawful business enterprise that has atleast five full-time employees and an annual turn-over of NZ$1 million.

Ownershipmeans owning at least 25 percent of a business.

Alawful business enterprise is an organisation that operates lawfully in acommercial environment with the goal of returning a profit and is not set upprimarily for passive or speculative purposes.

Investment funds requirements for bothcategories

What are the requirements for investment funds?

Youmust demonstrate ownership of your nominated funds and/or assets, anddemonstrate that the nominated funds and/or assets have been legally earned oracquired. All invested funds must be placed in an acceptable investment(s).

Can I nominate funds that have been gifted tome?

Youmay nominate funds and/or assets which have been given to you unconditionallyand in accordance with local law. You will need to show that your donoracquired those funds and/or assets lawfully.

Ifsome of your funds and/or assets have been acquired by inheritance you willneed to provide appropriate evidence, eg probate or evidence from yoursolicitor, to show that they were acquired lawfully.

What is an acceptable investment?

Anacceptable investment is defined as investment that:

1.isin either one or more of the following:

obondsissued by the New Zealand government or local authorities, or

obondsissued by New Zealand firms traded on the New Zealand Debt Securities Market(NZDX), or

obondsissued by New Zealand firms with at least a BBB- or equivalent rating frominternationally recognised credit rating agencies (for example, Standard andPoor’s),or

oequityin New Zealand firms (public or private), including managed funds and:

2.iscapable of a commercial return under normal circumstances and has the potentialto contribute to New Zealand’s economy, and

3.isinvested in New Zealand in New Zealand currency, and

4.hasthe potential to contribute to New Zealand’s economy, and

5.isinvested in lawful enterprises or managed funds that comply with all relevantlaws in force in New Zealand, and

6.isnot for the personal use of the applicant(s), and is not (directly orindirectly) invested in residential property development or deposit takingfinancial institutions (e.g. banks or finance companies).

Note: that for the purpose of the Migrant Investment Policy, convertible notes areconsidered an equity investment.

What is meant by personal use of investmentfunds?

Personaluse includes a personal residence, car, boat or similar assets.

If my application for residence is approved inprinciple within what time frame do I have to invest my funds in New Zealand?

Youshould transfer your total investment funds to New Zealand and invest them inacceptable investments within 12 months of approval in principle.

Ifyou cannot liquidate your assets, transfer and invest your funds in New Zealandwithin 12 months of approval in principle, you may request a further 12 monthsto do so.

Ifyou do not transfer your funds within 12 months (or 24 months if extended) yourapplication must then be declined.

Can I come to New Zealand to investigateinvestment opportunities once my application has been approved in principle?

Onceyour application is approved in principle you are eligible for a 12 monthmultiple entry work visa to come to New Zealand to investigate investmentopportunities.

Ifapplicable, your partner and children are eligible for multiple entry visitor’svisas for the same period.If yourchildren wish to study during this period they will have to apply for a studentvisa and meet student policy.

Afurther 12 month multiple entry work visa is available if needed.

Do I have to transfer my settlement funds to NewZealand (Investor (Investor 2 Category))?

No,you are only required to transfer your nominated investment funds to NewZealand.
