U1 OBJECTIVES 宗旨

The purpose of New Zealand’s student policy is to contribute to New Zealand’s sustainable economic development by: 为了实现新西兰经济的可持续性发展，新西兰招生政策的宗旨是：a.facilitating the entry of genuine students, with a focus on attracting and developing students who have the skills and talent New Zealand needs; 便利优秀学生入学，吸引符合新西兰发展需要的多才多艺学员；b.increasing global connectedness; 增加全球互动；c.supporting the sustainable growth of export education capability; 支持出口教育可持续性发展；d.earning foreign exchange; 获得外汇收入；e.strengthening New Zealand education, while managing risk to New Zealand and maintaining social cohesion.加强发展新西兰教育事业，并控制风险维护社会凝聚力。

U2 THE NEED TO APPLY FOR A STUDENT VISA OR PERMIT 申请学生签证或许可证所需条件 U2.1 Persons requiring a student visa or permit 需要学生签证或许可证的人员

Immigration Act 1987 ss 6, 24(4) 移民法

A person must obtain a student permit in order to undertake study or training in New Zealand, unless they are: 必须取得学生许可证才可以在新西兰学习和培训，除了以下几种情况：a.a New Zealand citizen; or 作为一名新西兰公民；b.the holder of a residence permit; or 居留证持有者；c.the holder of a student permit; or 学生许可证持有者；d.the holder of a limited purpose permit granted for the express purpose of attending a course of study or training; or参加学习和培训课程的限制性许可证持有者e.the holder of any other type of temporary permit whose conditions have been varied to authorise the holder to undertake study or training in New Zealand; or异于被授权在新西兰进行学习和培训的任何一种临时许可证持有者；f. exempt from having to hold a permit; or 免除不得不持有许可证的豁免者；g.covered by the provisions of U2.5.等同于 U2.5 的规定。

U2.5 When a student visa or permit is not required 无需学生签证或许可证持有者

Immigration Regulations 1999 Schedule 1, Part 3 移民章程

A student visa or permit is not required in order to undertake:无需学生签证或许可证持有者是为了进行：a.any training (other than an apprenticeship or a cadetship) provided by an employer as part of the normal conditions of employment offered to the holder of a work permit (eg, routine-on-the- job training); or由雇佣者提供的任何培训（除了学徒培训和军校学员培训）作为正常雇佣条件一部分的工作许可证持有者； b.a single course of study or training lasting not more than 3 calendar months. 一个课程学习和培训不超过3个月的学习者

U2.10 Student permit conditions 学生许可证相关规定Immigration Act 1987 s 27 移民法Immigration Regulations 1999 reg 22移民章程

7-8-9 U3.5 Offer of a place

U3.10Course fees课程费用Immigration Regulations 1999 reg 22(e)移民法规1999Applicants must provide evidence of:申请人需提供以下证明a.exemption from course fees, or 免交学费证明b.payment of course fees, or 缴纳学费证明c.either a notice of the award of a full scholarship or, in the case of a fee scholarship student, a receipt showing payment of the course fee.全额奖学金奖励证明，或如果是申请减免学费奖学金的学生，需提供学费支付的收据

U3.15 Guarantee of accommodation住宿保证证明

Applicants must provide a guarantee of accommodation from either:申请人需提供住宿保证证明以下两种之一a.the education provider offering the place, or 所申请院校提供住宿的证明b.some other person prepared and able to provide accommodation.其它人提供住宿的证明

12-13-14 U3.20 Sufficient funds for maintenance while in New Zealand在新西兰生活的充足的资金保证a.Applicants must provide evidence to satisfy a visa or immigration officer that they have sufficient funds available to maintain themselves throughout the period of their stay in New Zealand. Evidence may include but is not limited to: 申请人必须向签证官证明在新西兰停留期间，自身有充足的资金支持。证明需包括，但不局限于：i.a notice of the award of a full scholarship; or 全额奖学金的奖励证明ii.the form Financial Undertaking for a Student (which covers a stay in New Zealand of 12 months only) completed either: 学生财务保证书（只涵盖在新西兰停留12个月）obefore the student’s arrival in New Zealand, by a sponsor who is in New Zealand, the applicant’s home country or a third country, or 在学生到达新西兰之前， 由新西兰的资助人，或是申请人本国的资助人，或者是来自第三国家的资助人填写oafter the student’s arrival in New Zealand, by a New Zealand citizen or resident; or在学生到达新西兰之后，由新西兰公民，或居民填写iii.funds held by or on behalf of the student.由学生自己管理，或有人代为学生管理的资金b.When determining whether a student has sufficient funds to maintain themselves throughout their stay in New Zealand, visa and immigration officers may consider the period of time for which funds have been held by the student and/or their ability to access funds for the period that they are in New Zealand. 在审核学生是否有充足的资金支持他在新西兰的学习生活，签证官要考虑该学生持有资金的时间期限，以及/或者在新西兰停留期间，学生支取资金的能力

U3.20.1 Amount of funds required for students taking courses lasting less than 36 weeks对于学习课程少于36周的学生的保证金数额要求Students taking courses lasting less than 36 weeks must provide:课程持续时间少于36周的学生必须提供：a.evidence that funds of the amount required for ordinary visitors have been deposited in New Zealand, or 证明在新西兰的账户有等同于普通旅游所需的资金数额b.a letter from an educational institution confirming that accommodation and other living expenses are included as part of a prepaid package. 由教育机构出具证明信，确认住宿和其他生活开销是包含在预付款项当中的。

Students taking courses lasting 36 weeks or longer must provide evidence to satisfy a visa or immigration officer that:课程时间持续36周，或多于36周的学生，需向签证官提供证明：a.they have NZ$10, 000.00 per year available to maintain themselves during their stay in New Zealand (travellers’ cheques or bank documents in the student’s name are acceptable); or 在新西兰停留期间，申请人需有每年10，000.00新币可以支配（旅行支票或学生名义下的银行文件的证明均可接受） b.(if they are citizens of Samoa and Tonga), a written guarantee of maintenance from a relative in New Zealand who is either a New Zealand citizen or resident.（如果是萨摩亚和汤加公民），可以由在新西兰的亲属（新西兰公民或居民）提供一份书面的资金保证

U3.30 Students aged 13 and under and students enrolled in Years 1 to 8学生13岁以下（包括13岁）和 就读于1年级至8年级的学生

Note: The Code Administrator is the Ministry of Education.注：主要监管部门是指教育部i.an order, pursuant to sections 78, 101 or 238(1)(d) of the Children, Young Persons and their Families Act 1989, in favour of the Chief Executive of the Ministry of Social Development; or ii.an order, pursuant to section 110 of the Children, Young Persons and their Families Act 1989, appointing the Chief Executive of the Ministry of Social Development as sole guardian; or iii.an order, pursuant to section 33 of the Care of Children Act 2004, whereby a child or young person is placed under the Guardianship of the Family Court or the High Court and the Chief Executive of the Ministry of Social Development is appointed as agent of the court with power and discretion to place the child.

U3.35.10 交换生

U3.35 Definition of ’domestic student’

U3.35本国学生的定义For the purposes of student policy a ’domestic student’ means a ’domestic student’ as defined in Section 2 of the Education Act 1989. The Ministry of Education holds a complete list of who is considered to be a domestic student for the purpose of fee payment and enrolment.学生优惠政策中所提到的本国学生，指的是1989年颁发的教育法规的第二项中对本国学生的定义。教育部掌握有那些具备免学费，可以申请入学的学生名单。

U3.35.1 Primary and secondary schooling domestic students who do not require a permitU3.35.1那些在小学和初中教育时期无需申请即可就学的本国学生

The following people are considered to be domestic students for the purpose of attending primary and secondary schools and do not require a permit in order to undertake study in New Zealand:符合下列条件的视为本国学生，为了普及新西兰的初级教育，本国学生在小学和初级中学就学无需申请。a. New Zealand citizens, including students from Tokelau, the Cook Islands and Niue. b. New Zealand residents. c. People who are exempt from the requirement to hold a permit by virtue of section 11(1) paragraphs (a) (b) and (f) of the Immigration Act 1987. These are: i. people who are entitled to diplomatic or consular immunity (see U8.10); and ii. members of a visiting force or its civilian component and their dependants (see U8.15); and iii. members of, or people associated with, a scientific programme or expedition under the Antarctic Act 1960.d. U3.35.5 Primary and secondary domestic students who require a student permit or limited purpose permitU3.35.5那些在小学和初级中学就学需要申请或者需附加条件入学的学生。The following people require a student permit or limited purpose permit in order to undertake study in New Zealand but are considered to be domestic students for the purposes of attending primary and secondary schools and are exempt from paying foreign course fees:

下列一系列被视为本国学生的人若要在新西兰就学需要申请在小学或者初级中学就读可以免除课程费a. Dependent children of any person who is in New Zealand to study under an exchange programme approved by the New Zealand Government. a.在新西兰政府支持的项目中，作为交换生来新西兰学习者的子女。b. Children whose application for permanent residence is under consideration and who are the dependent children of any person who is the holder of a New Zealand residence permit. b.那些已经拥有永久居住权的人的子女正在申请永久居住权，但还未批准。c. Students who are in New Zealand to study under an exchange programme approved by the New Zealand Government (see P4) are considered to be international students and are entitled to attend a primary or secondary school which is a signatory to the Ministry of Education’s Code of Practice for Pastoral Care of International Students (see U5.1), or a tertiary education institution. b. Such students require a student permit but do not have to pay course fees.

U3.40 Students who wish to change their course of study and/or education providerImmigration Act 1987 s 27(7)

U3.40学生若想变更自己的学习课程或学校的情形根据1987年移民法第27（7）条之规定a. A further student permit or variation of conditions, for the purpose of changing course and/or education provider, will only be granted if an immigration officer is satisfied that: i. the applicant meets the student policy requirements set out at U3.1; and ii. the applicant has not breached their permit conditions as set out at U2.10; and iii. the original student visa would have been issued for the proposed course and/or education provider; and iv. the applicant remains a bona fide applicant (see E5.1).
